The case involved a former employee who claimed she was entitled to increased compensation for an injury on the business owner’s premises. The former employee claimed the business owner engaged in serious and willful misconduct for not making certain repairs that allegedly caused the injury. Ms. Asterlin argued and the WCAB judge found that the employer had no knowledge of the condition that likely caused of the injury and so the employer had no liability for the increased compensation. The judge ultimately decided the entire case in favor of the business owner.
