In response to an increase in COVID-19 infection rates and hospitalizations in Sacramento County, on July 29, 2021, the Sacramento County Health Officer issued an Order adopting guidance from the California Department of Public Health (CDPH) regarding face coverings. The Order specifically requires that all person wear face coverings in indoor public settings and businesses, regardless of vaccination status. The Order applies to all Sacramento County indoor public settings and businesses, including those within the incorporated cities’ limits.
Those responsible for the operation of indoor public settings (i.e., business owners, venue operators, etc.) must require that all patrons wear face coverings and must post clearly visible signs at each entrance communicating the face covering requirement. Additionally, it is strongly encouraged that face coverings be provided to patrons at no cost. Individuals are not required to wear masks if they are: working in a closed office or room; actively eating or drinking; swimming or showering in a fitness facility; obtaining a medical or cosmetic service involving the face; or exempt under the CDPH guidance.
Employees must also abide by the Order. Although some employers and businesses are subject to the Cal/OSHA Emergency Temporary Standards (ETS), the ETS permits local health authorities to mandate more stringent measures, and therefore, the Order takes precedent over the ETS with regard to face covering requirements for employees.
Lastly, the Order lays out face covering requirements at mega-events. Attendees of indoor and outdoor mega-events must also wear face coverings when inside. At outdoor mega-events, attendees must wear face coverings in areas where 50% of the structure has impermeable walls (i.e., concession stands).
Individuals should still continue to follow CDC guidance for vaccinated and unvaccinated persons, as well as any applicable rules and/guidance.
The Order becomes effective on July 30, 2021 at 12:01 a.m. and will remain in place until it is either rescinded or amended by the Sacramento County Health Officer.
Los Angeles County and Yolo County issued similar Public Health Orders. Los Angeles County’s Order went into effect on July 22, 2021. Yolo County’s Order is set to go into effect on July 30, 2021.
